For the purposes of these Conditions, as well as the Privacy Policies, it will be understood as:

Vessel: any type of contraption capable of navigating on or under the water offered through this Website whether it be sailboats, boats, catamarans, jet skis, etc.

Owner: owner of the vessel that leases it, which can be any individual or legal entity, whether private or professional dedicated to this activity.

Tenant: individual or legal entity that leases the Vessel.

Hereafter, Owner and Tenant may be referred to collectively as «users»).

Lease: the assignment of temporary use of the Vessels by the Owner in favor of the Tenant. MCH YACHTS informs users that it is not responsible for the use of false, inaccurate, incomplete or outdated information provided by the Owners and Tenants.

Likewise, MCH YACHTS informs users that when they request the completion of their personal data for access to any functionality or service, they will mark some fields as obligatory, since they are necessary data for the correct provision of the service or access to the functionality in question. In this sense, users should bear in mind that, if they decide not to provide such data, they may not be able to complete their registration as users or they may not be able to enjoy said services or functionalities.

2. Information and conditions regarding the processing of your personal data

2.1 Purpose and legitimacy of the processing of your data

Depending on the form of interaction, as well as the profile of the users, either as Owner or as Tenant, MCH Yachts will process your personal data for the following purposes:

a) To manage the registration of the Owners and Tenants as users of our Website.

The treatment of the data of the users is necessary to identify them as such and give them access to the different functionalities and services that are available to them as registered users.

In this case, the processing of your data is necessary for the execution of the terms that regulate the use of our Website, since, otherwise, we could not manage your registration.

b) For the development, fulfillment and execution of the rendering of services that from MCH Yachcts we offer to our clients:

– Manage the link or contact between Owners and Tenants, with the aim of facilitating the promotion and rental of the different boats offered through our Website.

– Management of the invoicing and collection of the price for the Leasing of the Boats, as well as those of the services provided by MCH Yachts through our platform.

– Manage the procedures with the different port authorities and / or marinas that in each case were necessary or required by our customers.

In this case, the processing of your data is necessary for the execution of the contract for the provision of services that links us with our customers.

c) Customer service.

MCH Yachts will be able to use the personal information of the users to attend the requests, requests or queries that these realize through the channels of attention to the client (telephone and / or email), as well as to manage possible incidences.

4. Term of conservation

The term of conservation of the data of the users will depend on the purposes for which they are treated:

MCH Yachts will process the data of the users during the time that they maintain the condition of registered user, that is, until the users decide to unsubscribe and, in their case, during the time that is necessary to attend their requests or requests.

Additionally, and in relation to the foregoing, regarding the fulfillment of the corresponding legal obligations, the data will only be available and requested by Judges and Tribunals, the Public Prosecutor or the competent Public Administrations the time necessary to comply with such duties. In case Rent and Boats deems it necessary to identify the users, they may request a copy of a document proving their identity.
